Lawsuits against asbestos manufacturers and other companies are based on legal theories such as negligence and products liability. The evidence is that the asbestos manufacturers knew that asbestos products were unsafe because the asbestos dust created during use of their products caused mesothelioma, lung cancer, and asbestosis. However, the asbestos companies failed to warn workers about the dangers of asbestos. There are statutes of limitations in each state which establish the deadline by which you must file your asbestos claim, and within each state there may be a different statutes of limitations for a personal injury lawsuit and a wrongful death lawsuit.
